Many escorts are unaware of the laws that govern them. These laws
in the UK are aimed at controlling the sex industry and to eliminate
exploitation.
However, many
people still believe that the actual act of prostitution is illegal.
However, this isn't the case.
Below is a
brief summary of the legislation governing escort girls and prostitution
in the UK and a brief description of what they actually mean.
The Pimp
It is illegal for anybody to control the movements of escort girls.
It is also against the law to live off the earnings of a prostitute.
Even if you are the partner of the prostitute you are still liable.
This is displayed
in The Sexual Offences (S) Act 1976, section 12, subsections 1
& 4;
"1) a)
Every male person who knowingly lives wholly or in part on the
earnings of prostitution or b) in any public place persistently
solicits or importunes for immoral purposes, shall be liable of
conviction of imprisonment."
"4) Every
female who is proved to have for the purposes of gain, exercised
control, direction or Influence over the movements of a prostitute
in such a manner as to show that she is aiding, abetting or compelling
her prostitution with any other person, or generally, shall be
liable on conviction to imprisonment."
Brothels,
UK Law
Many girls that work in brothels have been unsure as to whether
they are breaking the law. However, legislation does not state
that a prostitute who works in a brothel can actually be held
liable for anything.
The people
that are targeted by UK law are the persons that run such an establishment.
It may be considered that a receptionist of a brothel is assisting
in the management of a brothel and may therefore be held liable.
Also if you are the owner or landlord of the premises in question
and have let the premises aware that they are being used as a
brothel you may also be held liable. This is indicated in Section
13 of The sexual offenders Act 1976
Any person
who a) keeps or manages or assists in the management of a brothel,
or b) being the tenant, lessee, occupier or person in charge of
any premises, knowingly permits such premises to be used as a
brothel, or c) being the lessor or landlord of any premises, or
the agent of such lessor or landlord, lets the same.. with the
knowledge that such premises.. are to be used as a brothel.. shall
be liable en summary conviction to a fine ..or imprisonment.
Soliciting, UK Law
The actual act of prostitution is not illegal. However to solicit
in a public place is. This could be anywhere on the street or in
a hotel bar for example. Case
law suggests that soliciting can be any action by the prostitute
to gain attention of another with intention of obtaining money
for sex. Therefore it is not necessarily an exchange of words.
The Civic
Government S Act 3982 Section 46 (1) defines this; A prostitute
(whether male or female) who for the purposes of prostitution
a) loiters in a public place, b) solicits in a public place or
in any other place so as to be seen from a public place, or c)
importunes any person who is in a public place, shall be guilty
of an offence.
Male

All the above laws are aimed also at male prostitution. However,
the law is very restrictive of male prostitution in the instance
of soliciting. As a male prostitute you are breaking the law when
soliciting in private as well as in public, as is shown in The
Criminal Justice (S) Act 1980 Section 80 (12);
A person who
knowingly lives wholly or in part on the earnings of another from
male prostitution or Who solicits or importunes any male person
for the purpose of procuring the commission of a homosexual act
shall be liable on conviction to imprisonment.
Independent
Escort Girls, UK Law
Private Flats, Escort Girls and Receptionists
This situation seems to be an unexplored area of the law. Independent
Escort Girls working in a private flat where they spend only their
own money and work alone is not illegal.
However many
independent escort girls who have flats prefer to use a receptionist
for security reasons. Technically this is not against the law.
However, the
prosecution may try to establish that the receptionist is also
working and therefore assisting in the management of a brothel,
or living off immoral earnings. However, this is very difficult
to establish and if a situation like this did arise it would most
likely be acquitted.
Seized
Property
If you are an independent escort girl who has been arrested and
your money and other property was taken you can get it back. Once
charges have been dropped even if the money taken was from working,
you still have the right to collect it.
